Measures on the Administrative Protection of Internet Copyright entered into force on 30 May 2005.
There are 19 articles in total. The Measures aim to protect the information network transmission right in Internet-based information services. Key points of the Measures are as follows:
- Where a copyright owner finds that any content communicated through Internet infringes its copyright, and sends a notice to the Internet-based information service provider, the service provider shall take measures to remove the relevant contents promptly, and preserve the copyright owner’s notice for 6 months.
- The providers of the content can also send a counter-notice to the service providers. After the counter-notice has been sent, the Internet-based service providers can promptly reinstate the removed contents.
