The Considerations for Trademark Registration Application by Natural Persons were promulgated on 6 Feb. 2007.
There are five articles in total, which aim to clarify how should natural persons apply for trademark registration.
The key points are as follows:
Natural persons engaged in the production, manufacture, processing, selection and distribution of goods or services provision may apply for trademark registration.
Individual businesses may apply for trademark registration in the trade name registered in the business license, or in the name of the person in charge in the business license.
Leaseholding farm households can apply for trademark registration in the name of the contracting party.
The scope of goods and services which a natural person applies for trademark registration shall be limited to the business scope approved by the business license or relevant registration documents, or to their own agricultural and sideline products.
