The Food Recall Management Measures was promulgated in 2015 and amended in 2020 respectively. The latest revision entered into force on November 3, 2020.
There are 46 articles in total, which aim to clarify that the food producers and sellers should stop production or sales, or recall unsafe food. The key points are as follows:
1.This approach is applicable to the suspension of production and sales, recall and disposal of unsafe food within China. (Article 2)
2.The State Administration for Market Regulation and its local government counterparts are the regulatory authorities in this field. (Article 4)
3.If the local market supervision bureau finds unsafe food, it shall notify the food producer and business operator to stop production and sales or recall it, and require it to take relevant measures to eliminate food safety risks. (Article 29)
4.If a food producer or seller finds that the food it produces or sells is unsafe, it shall immediately stop production or sale, or recall it, and take remedial, harmless treatment, destruction and other disposal measures for the unsafe food. (Article 8, 12, 23)
