The Measures for Filing Trademark License Contracts entered into force on 1 Aug. 1997.
There are 23 articles in total, which aim to stipulate how shall the Trademark Bureau file trademark license contracts.
The key points are as follows:
A trademark registrant must sign a trademark license contract if they permit others to use their registered trademark.
Within three months as from the date of signing the trademark license contract, the licensor shall submit a copy of the license contract to the Trademark Bureau for filing.
If the licensor is a foreign individual or foreign enterprise, they shall entrust the trademark agency designated by the State Administration for Industry and Commerce to act as its agent for the filing.
