On 26 Nov. 2020, the Supreme People’s Court, the Supreme People’s Procuratorate and the Ministry of Public Security jointly issued the Opinions on Several Issues Concerning Handling Cross-border Gambling Offences (“the Opinions”, 办理跨境赌博犯罪案件若干问题的意见) (Gong Tong Zi [2020] No. 14).
The Opinions mainly address the issues of Chinese citizens’ gambling in overseas casinos and online gambling groups, as well as the increase in cross-border online gambling offences, aiming to curb cross-border gambling offences and to achieve political, legal, and social effects all in a high level.
The Opinions cover a variety of matters, including the determination of crimes, accomplice and related crimes in the handling of cross-border gambling offences, the calculation and disposal of the gambling funds, jurisdiction issues, collection, examination and verification of the evidence, and the application of the criminal policy of combining leniency with severity in cross-border gambling offences.
