Organic Law for the National People’s Congress was promulgated in 1982 and entered into force on December 10, 1982.

The key points of this law are as follows:

1.Candidates for Chairman, Vice-Chairmen, Secretary-General and other members of the Standing Committee of the National People’s Congress, President and Vice-President of the People’s Republic of China, Chairman of the Central Military Commission, President of the Supreme People’s Court and Procurator-General of the Supreme People’s Procuratorate shall be nominated by the Presidium which, after consultation among the various delegations, shall decide upon a formal list of candidates, based on the opinion of the majority of deputies. (Article 13)

2.The Standing Committee of the National People’s Congress shall be composed of the following personnel: the Chairman; the Vice-Chairmen; the Secretary-General; and other members. Members of the Standing Committee shall be elected by the National People’s Congress from among its deputies. (Article 23)

3.A member of the Standing Committee may not hold office in the administrative, judicial or procuratorial organs of the state. (Article 23)

4.The legislative bills and other bills brought before the Standing Committee for deliberation shall be adopted by a simple majority vote of all its members. (Article 31)

5.The National People’s Congress shall establish a Nationalities Committee, a Law Committee, a Finance and Economic Committee, an Education, Science, Culture and Public Health Committee, a Foreign Affairs Committee, an Overseas Chinese Committee and such other special committees as may be deemed necessary by the National People’s Congress. (Article 35)
