The Protection Measures for Overseas Geographically Indicated Products entered into force on 27 Nov. 2019.
There are 14 articles in total, which aim to clarify how to protect overseas geographically indicated products sold in China, and regulate the use of names and special marks of overseas geographically indicated products in China.
The key points are as follows:
Overseas geographically indicated products refer to the products produced outside China, registered in and protected by the country or region of origin, and in conformity with the Provisions on the Protection of Geographically Indicated Products.
The application for protection of overseas geographically indicated products in China shall be handled in accordance with the agreement signed between the country to which it belongs and China or the international treaty to which both countries are parties, or in accordance with the principle of reciprocity.
These Measures shall be applicable to the application, acceptance, examination, approval, use of special marks, supervision and management, change and cancellation of overseas geographically indicated products.
