The Regulations on the Administration of Foreign-funded Telecommunications Enterprises were promulgated on 11 Dec. 2001, and amended in 2008 and 2016 respectively. The latest revision entered into force on 6 Feb. 2016.
There are 23 articles in total. The key points of the Regulations include:
Foreign investors and Chinese investors may jointly establish a telecommunication enterprise engaging in basic telecommunication business and value-added telecommunication business in the form of Sino-foreign joint venture within the territory of China.
If the enterprise engages in basic telecommunication business, the proportion of foreign investors’ investment shall not exceed 49%.
If the enterprise engages in value-added telecommunication business, the proportion of foreign investors’ investment shall not exceed 50%.
