On 4 Nov.2020, the Supreme People’s Court promulgated the Opinions on Supporting and Safeguarding Shenzhen in Building a Pioneering Demonstration Zone for Socialism with Chinese Characteristics (关于支持和保障深圳建设中国特色社会主义先行示范区的意见).
According to the Opinions, the SPC is to:
(1) Explore the new provisions of labor laws in the Internet industry. For example, how the court determines the labor relations and overtime under such modes as Uber. (Article 5)
(2) Study how to hear cases in the fields of asset securitization, cross-border finance, digital currency, mobile payment and so on. (Article 6)
(3) Study how to give scientific researchers some rights to scientific and technological achievements of their posts, thereby encouraging innovation. (Article 7)
(4) Study how to protect the rights of right holders to their data and promote the development of the data trading market. (Article 8)
(5) Explore how to protect intellectual property in the fields of artificial intelligence, Internet information, life information. (Article 11)
(6) Cooperate with Shenzhen in promoting the bankruptcy of natural persons. (Article 12)
(7) Support the establishment and development of the Maritime Arbitration Center of the Shenzhen Court of International Arbitration. (Article 13)
(8) Provide convenient conditions for qualified Hong Kong and Macao lawyers to represent civil and commercial cases in Shenzhen courts. (Article 15)
(9) Promote the establishment of cross-border bankruptcy recognition and assistance mechanisms. (Article 16)
