On 18 Nov. 2021, China’s National Anti-Monopoly Bureau was officially inaugurated.
The major functions of the newly established bureau are to draft anti-monopoly measures and guidelines, organize anti-monopoly enforcement work, guide enterprises in international anti-monopoly litigation, take charge of the fair-competition review, as well as promote international cooperation and exchange in anti-monopoly enforcement.
China’s anti-monopoly enforcement agency has undergone a series of evolution.
After the implementation of the Anti-Monopoly Law in 2008, China's anti-monopoly regulation was enforced jointly by the Ministry of Commerce, the National Development and Reform Commission, and the State Administration for Industry and Commerce at the same time.
Then after the institutional reform of the State Council in 2018, the anti-monopoly enforcement functions of the three departments were centralized in the newly established Anti-Monopoly Bureau of the State Administration for Market Regulation (SAMR).
All the anti-monopoly enforcement functions are now transferred to the newly established National Anti-Monopoly Bureau in 2021, which is juxtaposed with the SAMR and no longer an affiliate of it. This further strengthens China's anti-monopoly enforcement power.
