China's First Data Resources Tribunal Set Up in Zhejiang

On 18 May 2022, China’s first Data Resources Tribunal (hereinafter referred to as the “Tribunal”) was established in Ouhai Primary People’s Court, Wenzhou, Zhejiang.

As the first specialized tribunal in China with limited subject-matter jurisdiction over data resources cases, the Tribunal can handle criminal, civil, and administrative cases involving data resources.

Its specific jurisdiction includes:

(1) criminal cases concerning serious infringement of personal information, trade secrets, confidential business information, and other legitimate rights and interests, as well as crimes committed in the duty of data supervision;

(2) civil cases of tort liability or contract disputes involving infringement of personal information, trade secrets, confidential business information, and other legitimate rights and interests related to data resources.

(3) IP cases regarding unfair competition on the Internet and disputes over the ownership of data resources; and

(4) administrative cases or non-litigation administrative execution cases involving administrative licensing, information disclosure, administrative penalty, and administrative supervision of data resources.
