SPC Reports 9.12% Rise in Cases, Surges in Key Areas

On 24 Oct. 2023, China’s Supreme People’s Court (SPC) published key judicial data for all Chinese courts from January to September 2023.

The specific data is as follows.

Courts at all levels nationwide accepted 25.789 million cases, up 9.12% year on year; 23.509 million cases were concluded, up 6.67% year on year.

Among them, concluded criminal cases amounted to 1.234 million, a year-on-year increase of 11.28%; concluded civil and commercial cases reached 14.196 million, a year-on-year increase of 6.08%; concluded administrative cases numbered 487,000, a year-on-year decrease of 3.81%.

With the rapid development of express and food delivery and other delivery activities using motorcycles as the primary means of transportation, disputes related to non-motor vehicle traffic accidents have increased significantly. For instance, courts nationwide have accepted 41,000 new non-motor vehicle traffic accident liability disputes of the first instance, a year-on-year increase of 35.15%.

Courts nationwide concluded 24,000 foreign-related, Hong Kong, Macao, and Taiwan-related commercial cases at first instance, a year-on-year increase of 15.87%. Among them, the number of foreign-related cases increased by 42.49% year-on-year, indicating a gradual increase in international commercial disputes as foreign trade gradually recovers after the pandemic.

The number of first-instance intellectual property cases received by the courts nationwide was 371,000, an increase of 1.61%. Among them, patent contract disputes and patent ownership and infringement disputes saw significant increases of 42% and 27% compared to last year. Additionally, new cases involving infringement of computer software copyright reached 6,725, a year-on-year increase of 260%, while new cases involving infringement of utility model patent rights reached 6,438, a year-on-year increase of 31.6%.

In October 2024, an arbitral tribunal at the Beijing Arbitration Commission (BAC/BIAC) issued an interim measure based on the applicant’s request, which was later confirmed and enforced by the court through a preservation order. This is the first of its kind in China, confirming the validity of tribunal-issued interim measures and highlighting the pro-arbitration stance of Chinese courts.
